The HCBS Final Rule, introduced by CMS in 2014, aims to ensure Medicaid-funded Home and Community-Based Services (HCBS) support individuals in a way that aligns with their personal preferences and goals. This rule applies to all Adult Care Facilities (ACFs) in New York State, including Adult Homes, Enriched Housing Programs, and various types of Assisted Living Residences (ALRs).
The DOH has issued a Compliance Assessment to all ACFs as part of the state’s remediation plan and to assist in evaluating adherence to HCBS standards. This assessment helps facilities evaluate their adherence to HCBS standards, such as promoting community integration, person-centered care, and individual autonomy.
Facilities must submit supporting documentation like policies, agreements, and training materials.
The survey, which must be completed in one sitting, has a 14-business-day deadline for ALPs and a 21-business-day deadline for other ACFs.
