Q&A RE: Overnight Guests
Could you please provide guidance on the expectations for accommodating overnight visitors per ALR and HCBS regulations? For example:
Facilities should establish their own policies and procedures for overnight guests, as there isn’t a one-size-fits-all solution for this issue. Please see answers below.
Is the facility expected to provide sleeping-compatible furniture in the resident’s room (is that even permitted?)? A separate room?
Additional furniture is not required, although it is appreciated if available. Consider whether the room is shared or designated for single occupancy. A separate room is also not mandatory; however, if you plan to use a separate room for visitors, you would need to meet the necessary equivalency requirements.
Can the facility impose a limit on the number of overnight visitors allowed at one time?
You can set limits, but ensure that they are clearly outlined in your policies and procedures. There may be unusual situations, such as with hospice care, where adjustments might be necessary. In such cases, you can always document the situation and handle it on a case-by-case basis.
Can the facility establish a limit on the duration of an overnight visitor’s stay?
You can set a limit, which should be included in your policy and procedures. This limit may also vary based on the availability of space.
Is the facility permitted to implement a policy requiring advance notice (e.g., at least 48 hours) for overnight visitors?
You may require advance notice but should consider special situations, such as hospice or illnesses.
Please ensure that if you allow overnight guests, you include their information in your emergency preparedness plan and that they know what to do in case of an overnight emergency.
