CMS Update for the LTC Healthcare Staff Vaccination Mandate
At this time, SNF and AL facilities must adhere to the NYSDOH mandate for COVID vaccinations. Per NYSDOH, it is permissible to allow a new employee to start work in a healthcare facility as long as they have received their first COVID vaccine.
As stated in the attached CMS Memo: QSO-22-07-ALL and QSO-22-07 ALL Attachment A-LTC when the CMS Interim Final Rule Phase Two goes into effect, the CMS Interim Final Rule mandate will be more stringent than NYSDOH. The CMS Interim Final Rule, revised on December 28, 2021, mandated healthcare staff will need to get the first vaccine by January 27, 2022 (Phase One) and complete the two vaccines (Phase Two) in order to meet the vaccine requirements for healthcare workers employment (unless receiving state accepted exemptions) as of February 28, 2022.
