Reciprocity – Hiring CNA’s From Other State

Providers have asked if facilities may hire CNA’s from out of state? The answer is yes, following the rules below. The “Book of NYS CNA Rules” is attached, see page 30 for Hiring CNA’s from other states, Page 4 for certification route 2.

Hiring Nurse Aides from other State Nursing Homes may hire a nurse aide who is certified and on the registry in another state if the nurse aide’s certification is current and in good standing. The facility must obtain verification from the state or states in which the nurse aide is certified before the nurse aide may be hired or used by the facility. The facility must also ensure that the nurse aide has applied for NYS Nursing Home Nurse Aide certification following certification route 2.

If the nurse aide has applied for certification under route 2, the facility may utilize the nurse aide during this period as long as:

  • The facility maintains a copy of the nurse aide’s NYS NAR application form submitted for reciprocity, or can verify that such an application is in fact being submitted within the next two business days, or has in fact been submitted for NYS reciprocity, and
  • Registry verifications are made and received by the facility from each state where the nurse aide has been listed on a registry.
