Draft 70/40/5 and Minimum Staffing Regulations

On Thursday, October 7, 2021, the Codes Committee of the Public Health and Health Planning Council (“PHHPC”) will be discussing, among other things, the recently released draft regulations for the 70/40/5 legislation and the 3.5 minimum staffing legislation. As draft regulations, they will be subject to the normal 60-day public comment period, subsequent administrative review and possible amendment prior to final adoption by PHHPC. As previously noted, NYSHFA will be pursuing a dual-track administrative and legal approach in an effort to address member concerns regarding these regulations. NYSHFA will keep you updated as these matters progress.
