Bill Vetoed – SNALP Bill (A.7035-A, Fahy / S.2161-A, Rivera; Veto No. 100)
Last week the Governor vetoed the SNALP bill (A.7035-A, Fahy / S.2161-A, Rivera; Veto No. 100) which, you may recall, would require the Department to establish a special needs assisted living program for individuals with neurodegenerative diseases. To be eligible for the SNALP, a resident must require 24-hour care due to Alzheimer’s, dementia, etc. with behaviors. A SNALP designation would only be available for facilities that maintain an EALR and SNALR licensure. The veto message cited a potential violation with the federal HCBS settings rule which would place New York at financial risk of losing funding for the HCBS program. NYSCAL will be having additional conversations with the other associations to discuss next steps and how best to clarify confusion, as the SNALP would not be a Medicaid program which HCBS sets the standards for.
