ALP Minimum Wage Reconciliation Recoupment

NYSHFA/NYSCAL staff, along with staff from O’Connell and Aronowitz met with the Department of Health to discuss the ALP Minimum Wage Reconciliation and to gain a better understanding of the methodology used by the Department to arrive at the recoupment figures. During our conversation, the Department of Health reiterated that an incorrect regional calculation (versus a provider specific calculation) for 2017-19 resulted in overpayments to certain providers which now, per regulation, must be recouped. DOH confirmed that the minimum recoupment must be equivalent to 15% of a provider’s weekly Medicaid remittance. DOH did indicate that providers may contact them to establish a fixed amount repayment plan (interest free) that could result in a weekly recoupment amount less than the required 15% of Medicaid remittances. Providers should contact DOH at bimamail@health.ny.gov to request an alternate payment plan.
