Q: On our AL campus we have an Independent Living building as well. We have an AL resident that would like to dine in our independent living dining room regularly. Can the resident dine there regularly, or do we need some type of waiver? Do they need to be supervised by AL staff?
A: The resident has the ability to come/go as they please, including for all meals. In their chart, document risk and benefits of them attending most of their meals elsewhere, note that the resident is choosing to do this, have them resident sign in and out, and have a policy & procedure in place in case others want to do it.

Q: Is there a list of waivers like there is a list of equivalencies?
A: No, there is not a list of waivers. There are Medical Waivers (with no comprehensive list developed), Transitional Adult Home Waivers (which are part of the O’Toole Case), and Equivalencies (which has the Index/list).

Q: For HCBS regulations, if a resident has a private room with a private bathroom, there just needs to be a lock on the bedroom door, and not the bedroom and bathroom correct?
A: Correct, having a lock on the bedroom is sufficient, however having a lock on bathroom doors as well is preferred.

Q: Can you please advise when the state is going to pay the 1% owed to the ALP’s?
A: The 1% increase is still pending federal approval. We do not have a sense of when the State will get it.
