Emergency Regulations regarding Personal and Compassionate Caregiving Visitors in Adult Care Facilities and Nursing Homes

The New York State Department of Health has issued emergency regulations regarding personal and compassionate care givers in both adult care facilities and nursing homes.  The regulations add a new Section 485.18 to Title 18 NYCRR titled Personal and Compassionate Caregiving Visitation.  Facilities will be required to develop written policies and procedures to ask residents, or their designated representatives in the event the resident lacks capacity, at the time of admission or readmission or for existing residents within fourteen days of the effective date, which is June 1, 2021.  NYSCAL is developing a policy and a form for facilities to use to ensure compliance with the new regulations and will send this to members by the end of this week.
