ACTION NEEDED BY NOV. 6: Contact CMS on Minimum Staffing Requirements

This proposal has the potential to dramatically affect assisted living who will be at risk of losing staff in an already troubling workforce shortage environment. The staffing mandate does not create more caregivers; it just creates a situation of increased competition for the same number of staff. Read AHCA/NCAL’s Issue Brief here.

NYSCAL needs support from its assisted living members in helping AHCA/NCAL to generate 10,000 unique comments to CMS about how the proposed minimum staffing rule is ill-advised.

This proposal is not feasible for two major reasons – the staff does not currently exist nor does the funding. This proposal is completely unfunded with CMS projecting a cost of $4 billion annually. An independent third-party analysis predicts the cost to be closer to $6 billion annually.

Let CMS know they made a mistake.

This is a multi-pronged comment campaign. Contact CMS to weigh in on their proposal, using your own circumstance and examples to tell your story. Be sure to:

  • Explain who you are
  • Explain your commitment to quality and the residents you serve
  • Explain that the workforce is nonexistent
  • Make an “ask” – Tell CMS not to do this, but if they are, not to do it until the workforce returns. Detail your staffing challenges as an assisted living provider
