Attestation for Wage Parity Due October 1, 2022

NYSHFA|NYSCAL wants to remind downstate providers that that the 2022 Annual Wage Parity compliance certifications are due by October 1, 2022. Please note that the Wage Parity Provisions requirement only applies to those serving the downstate area. This applies to Certified Home Health Agencies (CHHAs), Licensed Home Care Services Agencies (LHCSAs), Medicaid Managed Care Plans, Consumer Directed Personal Assistance Programs (CDPAP), Fiscal Intermediaries (FIs), Managed Long Term Care Plans (MLTCP) and Long-Term Home Health Care Programs (LTHHCPs). The Department has indicated that this must be done electronically through the eMedNY Provider Portal. You will also be required to include the completion of the Department of Labor forms and financial statements by LHCSAs and FIs along with the receipt of information by plans.

Guidance issued on August 18, 2022, indicated that CHHAs and LTHHCPs are delayed.  Instructions for completing the form can be found at https://www.health.ny.gov/health_care/medicaid/redesign/mrt90/mltc_policy/21-03.htm and are clarified at https://www.health.ny.gov/health_care/medicaid/redesign/mrt90/mltc_policy/21-03a.htm  Attached is a copy of the reminder memo issued by the Department of Health.

Questions can be directed to the eMedNY Call Center at 800 343-9000.  Questions regarding the wage parity should be directed to hcworkerparity@health.ny.gov
