DOH Issues DAL 22-28-A-1 Residency Agreement Checklist

The New York State Department of Health has just issued DAL #22-28-a-1 that provides Operators/Administrators with a Residency Agreement Checklist.  Early this year, the Department of Health issued DAL 22-28 regarding model Residency Agreements and their addenda for ALRs.  As of the date of this DAL, existing ALRs and applicants for new ALR licensure may propose a substitute Residency Agreement that complies with the enclosed Adult Home or Enriched Housing Program Assisted Living Residence Residency Agreement Checklist as applicable to the ALR’s base license. This Checklist is required only if an operator is not using one of the methods outlined in DAL #22-28.  If you wish to modify your DOH approved existing Residency Agreements you can submit the document in Microsoft Word format both clean and redlined copies identifying the proposed changes to acfra@health.ny.gov.   The Department will conduct a  limited review of the redlined changes, but after that initial review, may require submission of a completed Checklist if the requested changes are extensive.
