AHCA Needs Your Help to Contact CMS on Minimum Staffing Requirements

AHCA seeks to generate 10,000 unique comments to CMS to demonstrate how the proposed minimum staffing rule is ill-advised. As such, NYSHFA|NYSCAL is seeking a massive response from all of our members. Your comments count.

AHCA held a webinar today to inform members of the steps needed to submit comments to CMS on the proposed rule. Mark Parkinson, AHCA’s President and CEO, detailed the policy and why it is unfeasible for two major reasons – the staff does not currently exist nor does the funding. The proposal is completely unfunded. The cost is projected to be $4 billion annually. The average cost to a facility will be approximately $300,000.

Let CMS know they made a mistake.

By using AHCA’s LTC Trend Tracker (a free service for members) facilities can determine their compliance with the proposed rule and whether they are designated as rural or urban. This is key to determine the length of time for the rule’s phase-in for your facility. This data can be found in the Top Line Report that was recently sent to members. This campaign is a multi-pronged approach: Contact CMS to weigh in on their proposal, using your own circumstance and examples to tell your story. Be sure to:

  • Explain who you are
  • Explain your commitment to quality and the residents you serve
  • Explain that the workforce is nonexistent
  • Make some “ask” 

Tell CMS that this “one-size-fits-all” approach is ill-advised as currently proposed. Follow the simple step-by-step instructions to submit your unique personalized comment by November 6 here. Anyone can comment so encourage your frontline staff and others within your facilities to do the same. CMS is required to read all comments submitted.
